No sanction against absent employees due to weather disturbances: DOLE

CALAMBA CITY: The Department of Labor and Employment (DOLE) Calabarzon has reminded employees that absences due to weather disturbances such as Typhoon Carina cannot be meted with administrative sanction from employers.

Dale Villafuerte, DOLE Calabarzon assistant labor inspection sector officer, clarified that Labor Advisory No. 17 Series of 2022 on the suspension of work in the private sector due to weather disturbances and similar occurrences is still enforceable.

‘The advisory is still in effect since there is no other current advisory amending or repelling the same,’ he said in a phone interview Wednesday.

Villafuerte said that under the advisory, it is still the prerogative of management, in coordination with their respective safety officers, to suspend work to ensure the safety and health of their employees during weather disturbances.

However, employees who fail or refuse to work by reason of eminent danger resulting from weather disturbances (such as the effects of Typhoon Carina) shall not be sub
ject to any administrative sanction, he quoted the section of the advisory.

Pending other company policies, it is mandated that if unworked, the employee is not entitled to a pay; if worked provided not less than six hours, an employee is entitled to the day’s wage, he said.

According to the Philippine Statistics Authority (PSA), the region has an industry-driven economy, hosting big companies in the electronics and semiconductor industries. It also has a vast human resource base for the manufacturing and services industries.
